The Secretariat of the National Certification and Accreditation Administration of China issued a statement on further standardizing certification bodies
Notice on Information Disclosure
Certification bodies:
Certification bodies shall disclose information such as basic certification specifications, certification rules, and fee standards in accordance with the law. This is not only an effective way to facilitate public inquiries and conduct social supervision, but also an important measure to implement the main responsibility and prevent unfair competition and irregular publicity. At present, a small number of certification bodies have not actively disclosed information as required, and a certain number of certification bodies have incomplete, inaccurate, and untimely information disclosure. In order to further standardize the information disclosure work of certification bodies, strengthen the standardization of certification activities, and improve the credibility of certification results, the relevant requirements are hereby notified as follows:
I. Relevant Regulations
The specific requirements for information disclosure by certification bodies are as follows:
Article 20 of the "Regulations of the People's Republic of China on Certification and Accreditation" requires that certification bodies shall disclose information such as basic certification specifications, certification rules, and charging standards.
Article 15 of the "Administrative Measures for Certification Bodies" requires that certification bodies shall publish the following information through their websites or other forms and ensure that it is true and valid:
1. A self-declaration that the certification activities are carried out in accordance with the law;
(2) Certification fields, certification rules, certification certificate format, and certification mark format;
(3) The name and address of the branch established to undertake its certification activities and the content of its certification activities;
(iv) Certification fee standards;
(V) The status of the certification certificate: validity, suspension, cancellation or revocation.
Compulsory product certification bodies shall also publish relevant information on compulsory product certification in accordance with the relevant regulations of the certification and accreditation supervision and management department of the State Council.
Article 19 of the "Certification Body Management Measures" requires that certification bodies should provide the public with a way to check the validity of certification certificates through their websites or other forms.
II. Work deployment
1. All certification bodies are requested to conduct a comprehensive self-examination in strict accordance with the above-mentioned laws, regulations and rules, and immediately investigate and rectify any non-compliance with the relevant requirements. After the self-examination and rectification are completed, a corresponding report will be prepared. The relevant report requirements are shown in the attachment.
(II) From 2025, routine administrative supervision and "double random, one public" supervision and inspection work will focus on the information disclosure of certification bodies, and timely administrative handling and notification will be made for situations that do not meet the relevant requirements. All certification bodies are requested to pay attention to this and ensure that they continue to meet the relevant requirements.
III. Other matters
All certification bodies are requested to conduct self-inspections truthfully and make rectifications in a timely manner in accordance with the requirements of this notice. Requirements for self-inspection and rectification reports of information disclosure by certification bodies
The self-inspection and rectification report includes but is not limited to the following contents:
1. Self-inspection progress
Including self-inspection implementation plan or plan, progress of self-inspection work, etc.
II. Current Status and Problems of Information Disclosure
Including the self-inspection results and existing problems of the certification body's information disclosure channels and content.
The information disclosed includes but is not limited to the website construction of the certification body; self-declaration of engaging in certification activities in accordance with the law; certification fields, certification rules, certification certificates and certification marks; the name, address and content of the branch company established to undertake its certification activities; certification service charging standards; the validity, suspension, cancellation or revocation status of the certification certificate; and the method of querying the validity of the certification certificate.
III. Rectification of problems found
It includes analysis of the causes, rectification measures and rectification results of problems discovered through self-inspection of information disclosure.
IV. Opinions and suggestions on the information disclosure of certification bodies
Including opinions and suggestions on further strengthening the information disclosure work of certification bodies.
